These are important, but they often miss a fundamental issue: GDPR Article 9. Understanding this gap has become critical for any organization processing sensitive data with AI, and it’s precisely why data sovereignty matters.
The Special Category Problem
Article 9 of GDPR defines “special categories” of personal data that require extra protection. This isn’t your typical name-and-email data. We’re talking about:
Health information
Biometric data (facial recognition, voice patterns)
Genetic data
Political opinions
Religious or philosophical beliefs
Trade union membership
Sexual orientation
If your AI system processes any of this, you’re in Article 9 territory. And here’s where it gets uncomfortable.
The Cloud Model’s Fatal Flaw
Most AI development today follows a familiar pattern: You send data to any cloud AI provider. Their models process it. You get results back. Simple, right?
Not when Article 9 is involved.
Article 9 doesn’t just say “protect this data better.” It says you generally cannot process it at all unless you meet very specific exceptions. The most relevant exception for most businesses? Explicit consent.
But here’s the problem: When you send health data to a cloud AI provider for processing, their processing of that data requires explicit consent too. Not just your processing, but the entire chain.
Think about this practically:
A patient gives consent for their doctor to use AI analysis
The doctor’s system sends health data to the cloud AI provider
That cloud provider now processes special category data
Where is their explicit consent from the patient?
Most user agreements with AI providers don’t contain the explicit, informed, specific consent required by Article 9. They contain general terms of service.
The “But We’re Just Processors” Defense
Cloud AI companies often position themselves as “data processors” under GDPR, not “controllers.” This is technically true, but it doesn’t solve the Article 9 problem.
Article 9 restrictions apply to processing itself, regardless of whether you’re a controller or processor. Being a processor means you need instructions from the controller (your company), but those instructions can’t bypass Article 9’s requirements.
You can’t instruct someone to do something illegal, even if they’re following your instructions.
Why Technical Security Isn’t Enough
Companies will point to their security measures:
“We encrypt data in transit”
“We don’t train on your data”
“We have isolated tenancy”
“We’re SOC 2 certified”
These are good security practices. They’re necessary. But they’re not sufficient for Article 9 compliance.
Article 9 isn’t primarily about preventing data breaches. It’s about restricting processing itself. You can have perfect security and still violate Article 9 if you lack the proper legal basis to process special category data.
The Practical Reality
Most companies using cloud AI for health data, HR applications, or other Article 9 scenarios are operating in a gray zone. They might have:
Business Associate Agreements (BAAs) that satisfy HIPAA but not GDPR
Data Processing Agreements (DPAs) that cover general GDPR but not Article 9 specifics
Security certifications that address technical controls but not legal processing grounds
None of these substitute for the explicit consent or other Article 9 exceptions actually required.
What Actually Works?
The uncomfortable truth is that for true Article 9 compliance with AI, organizations need fundamentally different infrastructure:
1. Sovereign AI Infrastructure
This is where European data sovereignty becomes essential. Running models on infrastructure that remains within EU jurisdiction, where data never crosses borders or enters third-party cloud environments. 2. On-Premise or Private Cloud Deployment
For organizations requiring absolute control, deploying models on infrastructure you own and operate ensures data never leaves your environment. This is increasingly the standard for healthcare organizations and other entities handling Article 9 data at scale.
3. Truly Explicit Consent
If using cross-border cloud models, organizations need specific, informed consent that explicitly mentions:
That data will be processed by third-party AI systems
Which providers will process it (including sub-processors)
For what specific purposes
With clear opt-in (not buried in terms of service)
This level of consent is difficult to obtain and maintain at scale.
4. Alternative Legal Bases
Article 9 has other exceptions beyond consent (medical diagnosis, public health, etc.), but these have strict requirements and limited applicability to most AI use cases.
5. Anonymization That Actually Works
Properly anonymized data isn’t personal data under GDPR. But true anonymization is harder than most people think, especially with AI that can infer sensitive attributes from seemingly innocuous data.
The Coming Reckoning
European regulators have been relatively lenient with AI companies as the technology evolved, but enforcement is tightening rapidly. The Irish Data Protection Commission, UK ICO, German BfDI, French CNIL, and other authorities are increasingly scrutinizing AI deployments particularly those involving cross-border data flows to US cloud providers.
Organizations that assumed “we have a DPA” equals compliance are discovering the reality is more nuanced. The Schrems II decision already invalidated Privacy Shield for transatlantic data transfers. Article 9’s special category restrictions add another layer of complexity that standard cloud contracts simply don’t address.
We expect the first major Article 9 enforcement action against an AI provider or user will serve as a watershed moment for the industry, similar to how Schrems II reshaped thinking about international data transfers.
What Organizations Should Do
If you’re deploying AI solutions that process Article 9 data, we recommend:
Audit your data flows. Map exactly what data goes where and identify special categories. This foundational step reveals exposure many organizations don’t realize they have particularly when using US-based cloud AI services.
Review your legal basis. Do you actually have explicit consent that meets Article 9 standards? Have you considered post-Schrems II implications for international transfers of special category data?
Evaluate sovereign infrastructure. Consider whether European AI infrastructure that keeps data within EU jurisdiction provides a clearer path to compliance than managing complex consent and transfer mechanisms with global cloud providers.
Engage your AI providers directly. Ask them specifically: “How do you address Article 9 requirements?” If they only discuss security measures or point to standard DPAs, probe deeper on the legal basis for processing.
Obtain qualified legal counsel. Work with privacy attorneys familiar with Article 9’s nuances and the intersection of data sovereignty with AI deployment, not just general GDPR compliance or vendor sales teams.
The Bottom Line
Cloud AI has transformed how organizations approach healthcare, HR, and countless other domains involving special category data. However, the common pattern of US-based cloud-first deployment creates fundamental tensions with Article 9’s protective framework.

Compliant AI systems that respect Article 9 are achievable. They require architectural choices that prioritize sovereignty, proper consent mechanisms where needed, and sometimes accepting constraints on what data can be processed where. The first step is acknowledging these requirements exist and choosing infrastructure designed to meet them.
The question facing European enterprises isn’t whether Article 9 enforcement will intensify for AI deployments, it’s when, and whether your infrastructure choices today will withstand tomorrow’s regulatory scrutiny.
